Federal Court Mandates Freedom of Abrego Garcia from Immigration Detention

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The situation stems from a erroneous removal to El Salvador in March, which the government later admitted was an error. Following his return to the United States to face human smuggling charges, he was held in immigration detention.

In her order, the court noted that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The legal proceedings center on disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing trial in Tennessee.

Conditions of Freedom

The judge, who was overseeing his challenge to deportation in a federal court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This order shifts his supervision to the Tennessee court.
