European Union Deforestation Regulation Effectively 'Dismantled' After Initial Fanfare
Originally hailed as a groundbreaking regulation that would combat the worldwide crisis of forest loss.
But, the revised version of the EU's deforestation regulation, previously touted as the crown jewel of the European Green Deal, has been passed in a severely weakened state, prompting criticism from its original architect and environmental politicians.
"It has been gutted," stated the law's original author, pointing to the exclusion of key obligations for later-stage companies to verify the origin of products like palm oil, soy, wood, beef, rubber, cocoa and coffee.
He warned that a reduced number of responsible companies, fewer data points, and less precise origin data would make enforcement and prosecution more difficult.
Political Dismantling
Environmental vice-president Marie Toussaint was more blunt, labeling the delays, loopholes and exemptions – including one for paper goods – as the "systematic weakening" of the law.
This outcome is a far cry from the demands of more than a million European citizens who supported an initiative in 2020 calling for a prohibition of deforestation-linked products.
At its launch in 2021, then-Green Deal commissioner Frans Timmermans trumpeted it as "the toughest legislation ever put forward to combat deforestation."
From Ambition to Compromise
The law's unravelling has been interpreted as the European Union retreating from its environmental promises. It faced significant delays, ostensibly over technical problems, which drew condemnation.
"By reopening this file instead of solving a simple IT problem, the commission opened Pandora’s box," remarked Toussaint.
In its first draft, the law mandated that firms to track commodities back to their exact plot of land using geolocation data, holding them accountable for forest loss along their supply lines with penalties and hefty fines.
"It wasn't bureaucracy for its own sake," Schally explained. "These rules were the tool that ensured enforcement, created a verifiable paper trail, and prevented firms from obscuring their activities behind opaque production networks."
Intense Lobbying
Yet, the rigorous checks provoked opposition in the EU capital from large companies, producer countries, conservative political groups and EU logging states.
Experts cite last year's EU elections as a decisive moment, shifting the balance of power less favorable toward environmental rules.
"Additional intense pressure has come from major export markets like the United States," said corporate sustainability professor, suggesting the commission gave in to some requests during negotiations.
The Weakened Final Text
In the final legislation features several critical weakenings:
- Retailers and traders were mostly exempted from conducting rigorous checks.
- A new exemption for small operators was created.
- A option for more reductions was opened for next spring.
- Only four countries – geopolitical adversaries of the EU – will face “high risk” scrutiny.
"Instead of tightening downstream obligations, it rolled them back," lamented Schally. "Moving obligations upstream, it reduced accountability."
Uncertainty for Companies
The protracted process and revisions have also created annoyance for businesses that complied early.
"It is very frustrating because we invested significant resources into complying," said a coffee company executive. "We invested in software, followed seminars and built a team... now they’re saying it may be changed. It’s a major letdown."
The Commission's Stance
A commission spokesperson supported the final law, saying: "The commission has responded to concerns and taken action to ensure a simple, fair and cost-efficient implementation."
"The new text ensures stability, which is crucial for companies and national regulators to successfully implement this vitally important law."
